Gun Control
Can President Biden Regulate Ghost Guns Without Violating the Second Amendment?
The debate about ghost guns is heating up in the USA. The administration of President Biden has attempted to put regulations in place to protect public safety, but some believe it infringes on the Second Amendment. The Supreme Court recently revived the administration’s law, which has sparked more controversy. Ghost guns are a problem unique to the US because they are untraceable weapons.
Without any markings or identification, ghost guns are a type of do-it-yourself firearm that doesn’t come with any record of origin. This complicated feature makes it almost impossible for law enforcement to trace them, leading to confusion over their production and ownership. Individuals often make ghost guns without licenses, increasing the risk of acquiring and owning guns without proper background checks.
Cody Rutledge Wilson, an advocate of gun rights, has made a name for himself by promoting the concept of creating untraceable firearms at home. Being a crypto-anarchist, he believes that any new laws aimed at curtailing the production of “ghost guns” can be circumvented with clever maneuvering on his part.
In California, ghost guns seem to be gaining popularity as firearm laws become more restrictive [2]. Recent data indicates that up to half of the guns found at crime scenes in 18 months from 2020–2021 were untraceable ghost guns. Although they have existed for some time, ghost guns are increasing yearly.
Across the country, ghost guns significantly impact the daily gun violence in communities of color, even though they haven’t explicitly been associated with mass shootings.
Supreme Court Revives Biden Admin’s Ghost Guns Regulation
Ghost guns are becoming a primary concern for President Biden’s administration, leading them to propose new regulations. The government’s firm stance on the issue is reflected in a recent Supreme Court ruling that revived this proposal. Anyone who constructs a homemade firearm must now include serial numbers. In addition, buyers of gun-assembly kits will also be subject to mandatory background checks.
Federal charges are a likely consequence of being caught with a ghost gun. If you have an unregistered firearm, the result could be a penalty or time in jail.
Ghost guns are a concern in America, as the government attempts to impose rules to safeguard the public despite the possibility of infringing upon the Second Amendment. Recently, the Supreme Court resurrected the Biden administration’s ghost gun law, demonstrating the government’s commitment to this issue. Whether these guidelines will decrease the number of ghost weapons circulating in the United States remains to be determined.
